Para GRUPO SENECA MÉXICO it is of utmost importance to build trust with our distributors and retailers through an open communication guaranteeing them that our products are fully legal in Mexico.

 

The following is certain information to allow our partners to identify national and imported cigarettes legally marketed in Mexico and thus AVOID ANY ABUSE BY THE AUTHORITY AND ILLEGAL SEIZURE (THEFT OF MERCHANDISE) that may happen during the transportation and marketing of Mexican and imported cigarettes.

 

For said purpose, it is important to take the following into consideration:

Out SENECA™ and SCENIC 101™ are cigarettes are manufactured in Canada and legally imported into Mexico. COFEPRIS has a number of LEGAL REQUIREMENTS to be complied with by foreign manufacturers to market their products in Mexico legally.

Articles 2, section I, 4, 6, section VIII, 12 sections V and IX, 13, 14, 30, 31 and 32 of the General Law for Tobacco Control and Articles 7, 9 and 15 to 19 of the Regulations of the General Law for Tobacco Control.

CIGARETTES legally IMPORTED into Mexico are subject to CONTROLS IN ADDITION TO INSPECTION AND MONITORING IMPOSED ON CIGARETTES MANUFACTURED IN MEXICO, such as Prior Import Health Permits, obtainment of a Specific Sector Importers Number at the Tax Administration Service and verification and monitoring controls of the customs authorities.

Health Permits: Article 31 of the General Law for Tobacco Control and Articles 15 to 29 of the Regulations of the General Law for Tobacco Control.

Specific Sector Importers Number: Section A of Exhibit 10 to the General Foreign Trade Rules.

 

Inspections: Article 32, Section II, of the General Law for Tobacco Control and Articles 25 and 27 of the Regulations of the General Law for Tobacco Control.

SENECA™ and SCENIC 101™, IN ADDITION TO their compliance with all legal requirements established in Mexico, have the authorization from the Canadian government and the CORTESA and ISO INTERNATIONAL CERTIFICATIONS.

Steps to VERIFY THE LEGALITY OF MEXICAN OR IMPORTED CIGARETTES:

I). Check that cigarette packs have the information regarding THE PRODUCER OR IMPORTER VISIBLE.

 

II). Check that the RFC (FEDERAL TAXPAYERS NUMBER) OF THE PRODUCER OR IMPORTER is listed in the SAT webpage and that it is domiciled in Mexico.

 

III). Check that cigarette packs are in Spanish and that they have the following words printed on them: "FOR EXCLUSIVE SALE IN MEXICO" as well as the emissions of tar, nicotine and carbon monoxide. Articles 19, 21 and 22 of the General Law for Tobacco Control.

 

IV). Check that cigarette packs mention the HEALTH NOTICES AND PICTOGRAMS published by the Ministry of Health. Article 18 of the General Law for Tobacco Control.

 

V). Check that the BRAND printed on the cigarette pack does not have an ALERT NOTICE as an ILLEGAL BRAND by COFEPRIS. Last publication, June 2018.

Mom-and-Pop shops and merchants DO NOT NEED TO HAVE A SANITARY LICENSE, COFEPRIS PERMIT AND/OR AN IMPORT DECLARATION to sell imported cigarettes (see Articles of the Law):

These documents are only necessary for Importers (Articles 9 and 15 of the Regulations of the General Law for Tobacco Control).

LEGAL OBLIGATIONS to be complied with by the Mom-and-Pop shops and merchants for the SALE OF MEXICAN AND IMPORTED CIGARETTES:

I. Have a printed notice inside the establishment reading that it is prohibited to market, sell, distribute or supply cigarettes to minors.

 

II. Ask any young person who wants to purchase cigarettes to prove his/her legal age with an official identification.

 

III. Do not sell cigarettes by the unit.

 

IV. Do not make cigarette packs easily available to be taken directly by consumers.

 

V. It is prohibited to sell cigarettes by telephone, by mail or through the Internet.

 

Article 16 of the General Law for Tobacco Control.

Mom-and-Pop shops and merchants DO NOT NEED an IMPORT DECLARATION to TRANSPORT IMPORTED CIGARETTES within Mexico.

Article 146 of the Customs Law states that it is sufficient to submit a copy of the purchase invoice to transport any foreign merchandise within the Mexican Republic.
